Service Agreement

This agreement is between Caleb (the "Artist," contactable at keysbycaleb@gmail.com) and the individual completing this form (the "Client").

Article 1: Services

1.1 Event Details: The Artist agrees to perform for the event detailed in the booking form, upon confirmation of availability and final agreement with the Client.

1.2 Scope of Work: The Artist will provide live piano music for the number of hours specified by the Client at the agreed-upon hourly rate. The performance will align with the musical styles and specific song requests discussed and agreed upon with the Client. The Artist's role is to provide musical entertainment only.

Article 2: Compensation

2.1 Hourly Rate: The rate for hourly service is as stated on the website at the time of booking. There is a two (2) hour minimum for all hourly bookings.

2.2 Payment Schedule: A non-refundable retainer equivalent to 50% of the total estimated fee is required to secure the event date. The remaining balance is due no later than seven (7) days prior to the event.

Article 3: Logistics

3.1 Date & Time Confirmation: The event date and performance times are secured only upon receipt of the retainer and a signed agreement (to be sent after this initial request).

3.2 Cancellations: If the Client cancels the event, the retainer is non-refundable. If the event is canceled within 30 days of the performance date, the full estimated fee is due.

3.3 Postponement: If the event is postponed, the Client may apply the retainer to a new date within twelve (12) months of the original date, subject to the Artist's availability.

3.4 Technical Requirements: The Client or venue must provide a safe, level performance space (approx. 5'x6') and access to one standard electrical outlet. If a piano is not available on-site, the Client agrees to the use of the Artist's professional digital piano. The Client/venue shall provide **one professional powered speaker with a standard XLR or 1/4-inch input.**

Article 4: Client Responsibilities

4.1 Safe Working Environment: The Client must ensure a safe, non-threatening environment for the Artist. This includes protection from inclement weather for outdoor events.

4.2 Communication: The Client agrees to provide timely information regarding event timelines, song selections, and logistical details.

Article 5: Artist Responsibilities

5.1 Professionalism: The Artist will perform in a professional manner, with appropriate attire, and will arrive sufficiently in advance for setup and sound check.

5.2 Equipment: The Artist will provide all necessary musical equipment, excluding items specified in section 3.4.

Article 6: General Provisions

6.1 Governing Law: This Agreement shall be governed by the laws of the State of California.

6.2 Limit of Liability: In the unlikely event the Artist is unable to perform due to illness or unforeseen circumstances, liability is limited to a full refund of all payments received.

6.3 Entire Agreement: This document, along with the finalized booking confirmation, constitutes the entire agreement between the Client and the Artist.
